Elytic may be accessed worldwide. You are responsible for ensuring your use complies with the laws that apply to you. These Terms do not limit rights that cannot legally be limited under applicable consumer protection laws.

You must have legal capacity to agree to these Terms. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use of your account.

You are solely responsible for your use of Elytic and for any decisions or actions taken based on the service or any content. You assume all risks arising from your use of the service to the maximum extent permitted by law. You will comply with applicable laws and will not interfere with the operation of Elytic or other users' use of the service.

You are fully responsible for all content you transmit or make available through Elytic. You confirm you have the rights necessary to share such content. You agree not to use Elytic for unlawful activities, harassment, threats, impersonation, spam, infringement, or violations of privacy or other rights.

You retain ownership of your content. By submitting content you grant Elytic a worldwide, non-exclusive, royalty-free, transferable license to host, store, process, reproduce, and display your content for operating, improving, and protecting the service.

All rights in Elytic including software, interfaces, trademarks, and content are owned by Elytic or its licensors. No rights are granted to you except as expressly stated in these Terms.

You must not attempt unauthorized access, test vulnerabilities, bypass security, reverse engineer, scrape, bulk extract data, distribute malware, or interfere with network or service operations except where such prohibitions are not enforceable under applicable law.

To the extent permitted by law, Elytic may suspend or terminate accounts, remove or restrict content, or limit features at its discretion — including to enforce these Terms, protect users or the service, or comply with law. Upon termination your right to use the service ends immediately.

Elytic does not provide legal, financial, medical, or other professional advice. You are solely responsible for how you use any information obtained through Elytic and should obtain qualified professional advice where required.

Elytic processes personal data in accordance with its Privacy Policy and applicable data protection laws. By using the service you consent to such processing.

Elytic may modify, suspend, or discontinue the service or any feature at any time. Continuous error-free operation is not guaranteed and backups are your responsibility.

To the maximum extent permitted by applicable law, the service is provided on an 'as is' and 'as available' basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, or non-infringement. Your use is at your sole risk.

To the maximum extent permitted by applicable law, Elytic and its affiliates, officers, directors, employees, and partners are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business interruption, or opportunities arising out of or relating to the service or these Terms, even if advised of the possibility of such damages. Total aggregate liability will not exceed the greater of fees you paid to Elytic in the preceding twelve months or one hundred US dollars.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Elytic and its affiliates, officers, directors, employees, and partners from claims, losses, liabilities, damages, costs, and expenses — including reasonable legal fees — arising from your use of the service, your content, or your violation of these Terms or applicable law.

These Terms are governed by the laws that apply to the place of organization of Elytic, without regard to conflict of law principles, subject to any non-waivable consumer protections that apply to you.

To the extent permitted by law, any dispute arising out of or relating to these Terms or the service will be resolved through binding individual dispute resolution rather than through class or representative actions, where such waiver is permitted by law.

Elytic may update these Terms from time to time. Updated Terms become effective when posted unless otherwise specified. Continued use after changes means you accept the updated Terms.

Elytic AI is an optional assistant powered by a third-party AI provider (Google's Gemini API). You must be 18 or older to use it, and you must accept the in-app AI consent notice before your first use. Elytic AI is provided 'as is' for general information and entertainment; its responses are generated automatically and may be inaccurate, incomplete, biased, or offensive, and do not constitute medical, legal, financial, or other professional advice. You are solely responsible for how you use AI output. You must not use Elytic AI to generate or solicit unlawful, harmful, harassing, deceptive, or infringing content, to attempt to bypass its safety filters, or in any way that violates these Terms or our Moderation Rules. We may filter, log, rate-limit, suspend, or permanently revoke your access to Elytic AI at our discretion, including to enforce these Terms or comply with law.

Elytic may offer virtual currency ('Elytic Coins') and virtual items such as cosmetics and randomized 'mystery boxes.' Virtual currency and virtual items have no monetary value, are not your property, and constitute a limited, personal, non-transferable, revocable license to use them within Elytic. They cannot be redeemed for cash or exchanged for anything of real-world value, and they are non-refundable, except where required by applicable law or by the rules of the app store through which you transact. Where mystery boxes or other randomized items are offered for purchase, the relevant probabilities are disclosed at or before the point of purchase. We may create, manage, modify, price, or remove virtual currency and items at our discretion, and any unused balance is forfeited when your account is closed, suspended, or terminated.

Some features, virtual currency, and subscriptions (such as Elytic Gold) are available as paid in-app purchases. All purchases are processed by the platform you use — the Apple App Store or Google Play — and are subject to their payment terms; we do not receive your full payment-card details. Subscriptions renew automatically for the selected period until you cancel, and you can manage or cancel renewal through your App Store or Google Play account settings. Prices, contents, and availability may change. Except where required by law or by the applicable app store's policies, all purchases are final and non-refundable, and refund requests are handled by Apple or Google under their respective policies. Where you have a statutory right of withdrawal for digital content, you acknowledge that this right may be lost once delivery of the digital content begins, to the extent permitted by law.
